In circumstances where the parties require an order from the court in relation to the break-up of the marriage, an application can be made for a Judicial Separation.
the division of the assets of the marriage
maintenance of either or both spouses
with whom any children are to reside
access and the maintenance to be paid in respect of the children
An application can also be made for pension adjustment orders if such orders are needed. If the application is successful, the Court will also grant a Judicial Separation Decree.
To be entitled to apply for a Judicial Separation, the parties must have lived apart from one another for at least one year at the time of the application to the court.
Divorce can be applied for in circumstances where certain criteria are fulfilled and where the parties have lived apart from one another for at least two of the three years prior to the Divorce application to the Court.
