Probate

Probate is the legal right to deal with someone’s property, money and possessions (known as their ‘estate’) when they die. Only certain people can apply for probate. Who can apply depends on whether or not the person who died left a will in place.

If there is a will, the executor named in it can apply. If there is no will, the nearest next of kin can apply.

Once the application is made, a document called a Grant of Representation is issued. This allows the executor (or nearest next of kin) to distribute the estate of the person who died.

When a loved one dies, it is a difficult time for the family left behind but this can be made a lot easier, if the deceased has left a will which clearly sets out, what is to happen to the estate of the deceased.

In order for a Will to be legally enforceable, it needs to be proven with the Probate office of the High Court and this is known as extracting a Grant of Probate. This is a service we can carry out on behalf of our clients and indeed, all other types of applications to the Probate office, such as Letters of Administration, De bonis non grants etc. Once the Grant has issued from the Probate office, we will then ensure the proper administration and distribution of the estate.
