Brian McGrane, Solicitors, were instructed by a client who had been the victim of a road rage incident, where his vehicle had been reversed into deliberately by an angry driver of another vehicle.

 

As a result our client suffered personal injuries of a physical and psychological nature. An application was made to the Injuries Board, and an Authorisation was issued by the Board, as the respondent declined to have the claim assessed. Consequently, proceedings were issued against the third party for compensation in respect of the personal injuries suffered by our client. The case progressed and despite meeting the third party’s solicitors for settlement discussions on two occasions, the case did not settle.

 

We advised our client that we didn't feel the amount of compensation being offered at either settlement meeting, was appropriate compensation for our client’s injuries. As the meetings were unsuccessful, we set the case down for trial.

 

A few days before the hearing date, we were contacted by the defendant’s solicitors and following further negotiations, our client’s case was settled for €19,000.00, which was more than double the amount offered at the first settlement meeting.

 

Our client was very happy with the settlement, which was achieved without him having to give evidence at a trial.

The client’s relation - the deceased - had promised our client that they would receive a particular property...

 

However, the deceased’s Will did not include the bequest of the property to our client. We made representations to the executors of the estate of the deceased on behalf of our client. Our request was that the executors arrange to transfer the property to our client on the basis of the promise that had been made by the deceased. The executors of the estate indicated they were not prepared to transfer the property, in circumstances where no such bequest was in the Will of the deceased.

 

Accordingly, we issued proceedings against the estate, in the High Court on behalf of our client, seeking to obtain an order from the Court transferring the property to our client. The executors of the estate entered an appearance and delivered a Defence, to the proceedings. However, following two settlement meetings, the case was resolved by agreement, whereby the executors agreed to transfer the property to our client.

 

Our client was very happy with the result which meant that they did receive the property as promised by the deceased, without the necessity and expense of the matter going to trial.

In this case, our client was a pedestrian involved in a road traffic accident. He was hit by a motor bike while crossing a road.

 

Our client suffered serious soft tissue injuries, dental injuries, and scarring. In the first instance an application was made to the Injuries Board. The Board decided that it would not be appropriate to make an assessment and consequently an authorisation was issued by the Board, allowing the client to instigate Court proceedings.

 

Proceedings were issued in the High Court and the defendant’s solicitors, delivered a full Defence to our client’s claim. Despite the fact that, the defendant was disputing responsibility for the accident, the defendant’s solicitors looked to arrange a settlement meeting, on a “Without Prejudice” basis.

 

Brian McGrane Solicitors accepted the invitation to attend a settlement meeting at the Four Courts, Dublin. Following lengthy discussions, the client’s case was ultimately settled for €135,000.00, plus High Court costs.

 

This meant that our client was spared the stress and the delay, which would have been caused had the case proceeded to trial.

An offer of €25,000 damages by Ryanair to a 12-year-old schoolgirl, who was scalded on a flight from Lourdes just over five years ago, was rejected by a judge on Wednesday as inadequate. Barrister Darach MacNamara, who appeared in the Circuit Civil Court for Sienna Darcy, told Judge Michael Walsh that “a piping hot meal including oil and sauce,” had spilled on her left hand.

 

The young girl who sued through her mother alleged in her €60,000 damages claim that a hot pasta meal had been placed before her by cabin staff on what was claimed to be an unstable extendable table. Mr MacNamara, who appeared with Brian McGrane Solicitors, told Judge Walsh that liability was no longer an issue in the case and he was recommending that the court reject the Ryanair offer of €22,390 general damages and €2,610 special damages.

Brian McGrane Solicitors were instructed to act on behalf of a client who had experienced physical and psychological injuries at her workplace.

 

Whilst undertaking her duties at her place of work, our client suffered both physical and psychological personal injuries. The claim was initially sent to the Personal Injuries Assessment Board (PIAB) and duly processed. But the PIAB declined to assess the claim because (it was felt) that it would not be appropriate to make an assessment. Undeterred, proceedings were subsequently issued on behalf of the client.

 

The claims handlers, acting on behalf of the client’s employers, requested a settlement meeting to discuss the possibility of settling the client’s claim, on a “without prejudice” basis. Accordingly, a settlement meeting was arranged at the Four Courts in Dublin and following the subsequent negotiations the client’s claim was settled for the sum of €40,000.00, plus costs.

 

Our client was very happy with the result we achieved by way of settlement because it meant she didn't have to experience the stresses of giving evidence at the trial of an action. It also meant that the case was satisfactorily concluded in a shorter time.

Brian McGrane Solicitors acted on behalf of a client who, while out jogging, tripped on an uneven footpath and suffered personal injuries.

 

An application was made, on behalf of the client, to the Injuries Board naming the Local Authority as the entity responsible for the injuries. The Local Authority declined to have the claim assessed by the Injuries Board. Accordingly, Brian McGrane advised the client to institute proceedings in the Circuit Court, to obtain compensation for the injury suffered.

 

The proceedings were issued, and the Local Authority entered an Appearance and a full Defence to the claim. However, despite having delivered a full Defence to the claim, Brian McGrane, Solicitors managed to arrange a “Without Prejudice” settlement meeting with the Local Authority’s solicitors, at the Four Courts. Following hard fought negotiations, we managed to secure a settlement for our client, in the sum of €20,000.00 plus costs. The client was delighted with the settlement amount, especially in circumstances, where the client did not have to proceed to a trial in respect of the case.

Brian McGrane Solicitors successfully achieved a three-fold award increase for their injured client.

 

Our client was involved in a road traffic accident whilst driving and as a result she suffered personal injuries. She lodged a claim with the Personal Injuries Assessment Board* which resulted in a PIAB Assessment of an award of just over €13,500.00. The client took the legal advice given and rejected the PIAB assessment, having been advised that the level of compensation assessed by PIAB was not sufficient compensation, for the injuries suffered. Court proceedings were issued on behalf of the client and the defendant’s solicitors defended the proceedings.

 

Brian McGrane Solicitors managed to arrange a settlement meeting with the defendant’s legal team. Following protracted negotiations at the Four Courts, Brian McGrane Solicitors ultimately settled our client’s case for the sum of €50,000. The client was delighted with the result which was far in excess of the PIAB assessment and also meant that the client did not have to go through the difficult experience of having the case heard in Court.

Our client slipped on ice at work and sustained soft tissue injuries.

 

Our client suffered injuries at work, when they slipped on ice and unfortunately, sustained soft tissue personal injuries. The client’s employers were notified of the client’s injuries and a claim was initiated on behalf of the client.

 

An application was made to the Personal Injuries Assessment Board (PIAB) on behalf of the client and the insurers of the client’s employers declined to have the case assessed by PIAB. Generally, this is an indication that liability is being denied and that the case will be fully defended.

 

The client was advised that the claim was a good case, and it was suggested that they should issue proceedings before the Courts. The client accepted the advice given and confirmed that they wished to institute a personal injuries claim.

 

A personal injuries summons was issued on behalf of the client. The defendant’s solicitors entered an Appearance and delivered a Defence to the proceedings. Ultimately, the insurance company acting on behalf of the employer, made an offer. Subsequently, negotiations took place and ultimately, the claim was settled for €15,000.00 plus costs.

 

The client was happy that they had secured substantial compensation for their injuries without the necessity and stress of having to proceed to trial.

Brian McGrane Solicitors was instructed by a client who had been involved in a road traffic accident in Dublin.

 

The client was cycling on a main road in Dublin when a car struck her bicycle from behind causing her to fall and hit the ground. The client suffered some minor superficial injuries as well as a radial arm fracture, which eventually healed well.

 

Unfortunately, the client hadn’t managed to obtain the insurance details from the driver of the vehicle that hit her bike at the time of the accident and was unable to trace the vehicle. The client was advised, that in such circumstances, a claim for compensation could be made directly to the Motor Insurance Bureau of Ireland (M.I.B.I.). An application was made to the MIBI on behalf of the client and having complied with its requirements regarding the claim, the MIBI appointed insurers to deal with the claim.

 

The insurance company appointed by the MIBI sought to arrange settlement talks before the claim was to be submitted to the Personal Injuries Assessment Board. Now known as Injuries Resolution Board.

 

Brian met with the insurance company’s claims handler at the Four Courts in Dublin for settlement discussions and they made an offer of €20,000.00 - plus expenses incurred - to settle the client’s claim. Following protracted negotiations, the claim was ultimately settled for €32,000.00 - plus a contribution towards costs. The client was especially pleased, as the settlement meant that there would be no necessity to submit an application to the PIAB, which would have taken much longer to conclude.

A client of Brian McGrane Solicitors suffered injuries, as a result of a road traffic accident, which occurred while a client was on holidays in France. The client was cycling in the Alps when the bicycle was struck by an oncoming vehicle. As a result of the collision, the client suffered multiple soft tissue injuries. Brian advised the client that under European Regulations and the adoption of same into Irish law, that the client was entitled to bring proceedings in Ireland in respect of a personal injuries claim.

 

Brian initiated the claim on behalf of the client with the French insurers of the vehicle, who contested liability. Brian made an application to the Personal Injuries Assessment Board (PIAB) on behalf of the client. As expected, given the fact that the accident occurred outside Ireland, PIAB declined to assess the claim and issued an Authorisation which entitled the client to issue proceedings in Ireland. Brian issued proceedings in Ireland on behalf of the client against the French driver and owner of the vehicle and their insurers. The case progressed and ultimately the French insurers, through their Irish solicitors, sought to meet to discuss possible settlement of the case. A settlement meeting took place at the Four Courts, Dublin and ultimately the case was settled for a figure in excess of €25,000.00 plus costs.

€17,000 awarded to Dublin cyclist involved in a taxi door opening up on a main road causing a traffic collision

 

Brian McGrane Solicitors represents a cyclist injured by passenger opening a taxi door.

 

A passenger, opening the door of a taxi in Dublin, knocked a passing cyclist off their bicycle. On seeking advice, our personal injuries expert solicitor advised that there were grounds to seek compensation in respect of the injuries sustained.

 

The taxi owner’s insurance company indicated that they would seek to settle the case on a ‘Without Prejudice’ basis. We arranged to obtain the required medical evidence in relation to our client’s personal injuries. We engaged with the claims department of the insurance company, who initially made an offer of €10,000.00. This sum would include the client’s “out of pocket” expenses, plus a contribution towards the client’s legal costs. Our client indicated that they would be happy to accept this offer. However, we advised that the offer should be rejected, and the client agreed to take our advice.

 

Following further negotiation with the claims handler acting on behalf of the insurance company, we were able to secure a settlement for more than €17,000.00, which included the contribution towards the legal costs.

 

Our client was particularly pleased that the matter was settled swiftly, and without the need for us to make an application on their behalf to the Injuries Resolution Board, a process which generally takes approximately a year to finalise.

Brian McGrane Solicitors was instructed by a client who suffered personal injuries in the car park of a well-known supermarket

 

Due to the poor state of the supermarket’s car park surface, a customer’s loaded trolley over-balanced and toppled over. To prevent the trolley from spilling the contents, the customer sustained a significant shoulder injury.

 

Representing his client, Brian McGrane made an application to the Injuries Board. The supermarket chain agreed to the claim to be assessed by the Board. Ultimately the Injuries Board issued an assessment of the client’s claim in the region of €43,000.

 

Although the assessment was a significant amount, Brian advised his client that he considered it to be insufficient compensation for the injuries he had suffered. The client agreed with Brian’s advice and rejected the assessment sum, which had been accepted by the supermarket chain. The Injuries Board issued the authorisation which enabled the client to instigate court proceedings. Subsequently, the solicitors acting on behalf of the supermarket invited Brian McGrane Solicitors to settlement discussions which resulted in a raised settlement offer of €50,000, which was accepted by the client.

 

The client was pleased that they had taken Brian’s advice and were delighted to receive the higher amount of compensation in respect of their injuries.
